The trial’s emotional centre sits in Stages 8 and 9: prosecution witnesses testify, exhibits are marked, and the accused faces point-wise questions under BNSS Section 351 (the successor to old Section 313). Months of adjournments often cluster here. Families who understand what each date is for — and what not to do in the corridor — support defence work without harming it.

Stage 8 — Prosecution evidence
Prosecution must prove charges through lawful evidence. The court records examination-in-chief, cross-examination, and re-examination of each prosecution witness (PW).

What families see in court
- IO may testify as PW
- Complainant and eyewitnesses
- Medical officers, forensic witnesses
- Document witnesses for seizure and certification chains
What families should not do
- Signal witnesses from gallery
- Argue with complainant side in corridor
- Coach witnesses outside court procedure
- Record audio/video where prohibited
Delay patterns
Witness non-appearance is the classic delay driver. Orders may read “PW not present, next date.” Track each PW separately in a sub-sheet: name, date fixed, appeared or not.
Closing prosecution evidence
When prosecution closes, the court records that prosecution evidence is closed. Defence then chooses whether to lead evidence (Stage 10) or argue that prosecution failed without leading witnesses.
Stage 9 — Statement of accused (BNSS 351)
After prosecution evidence (and before defence evidence if any), the court puts incriminating circumstances from the record to the accused. The accused may explain each point. This is not general storytelling — it is structured questioning tied to evidence already on record.
Old language: Lawyers and families still say “313 stage.” BNSS Section 351 performs the familiar function with updated numbering.

Preparation principles
- Review incriminating circumstance list with counsel beforehand
- Avoid improvised new factual theories on the stand
- Silence on a point is lawful but has strategic implications — counsel decides
- Written statement modes depend on court permission and practice
What 351 is not
It is not final arguments. It is not cross-examination of prosecution witnesses. It is not a chance to introduce fresh documents without following exhibit procedure.
BNSS digital record habits
Electronic exhibits and chat extracts increasingly appear in prosecution evidence. Families should preserve original devices and metadata timelines counsel requests — not curated screenshots alone.
Attendance decisions
Accused on bail must attend unless exempted by order. Family members need not crowd the courtroom; one organised note-taker helps more than a large emotional group.
Note-taking system for families
| Column | Content |
|---|---|
| Date | Hearing date |
| PW no. | As court labels |
| Appeared? | Y / N |
| Key answers | One line only |
| Next date | From signed order |
Share notes with counsel after each day — not mid-examination from the gallery.
Bridge to Stage 10
If defence leads evidence, Stage 10 follows 351. If defence does not lead evidence, arguments stage approaches after formalities. Do not assume acquittal because prosecution witnesses were weak — assessment happens at arguments and judgment.
This-week checklist
- Maintain PW sub-sheet for Stage 8 with next three dates.
- Photograph daily order after each PW hearing.
- List exhibits marked so far (numbers and objects).
- Confirm whether PE is part-heard or closed.
- If 351 fixed, schedule prep meeting before that date — not after.
- Avoid discussing case facts with prosecution witnesses.
- Ask counsel: “After PE close, will we lead defence evidence?”
FAQs
Can 351 happen before prosecution finishes?
Ordinarily after prosecution evidence closes. Split or exceptional orders require counsel interpretation.
What if accused is sick on PW date?
Inform counsel immediately; medical applications need timely filing.
Does hostile witness end Stage 8 early?
Hostile marking is one witness event; prosecution may still close after remaining PWs.
Can family answer for accused at 351?
No. Accused answers personally unless court permits otherwise in exceptional modes.
