If Police Call You Without a Warrant – What Are Your Rights?
Getting a phone call or verbal notice from the police can be stressful—especially when no written document or warrant is shown. But under Indian law, not every police call means you are under arrest or guilty. You must understand the difference between a legal summons and an unlawful demand.
🔹 Can Police Call You Without a Warrant?
Yes, in some cases, the police can call you for questioning. But this must follow legal procedure. Under Section 41A of the Criminal Procedure Code (CrPC), police must issue a written notice if they wish to question someone who is not being arrested.
Without this notice, you are not legally required to go to the police station.
🛑 Your Rights If the Police Call You
1. Right to Know Why You’re Being Called
Police must inform you clearly and in writing if they want to question you.
2. Right to Remain Silent
You have the right to remain silent and not answer questions that may be used against you in court (Article 20(3) of the Constitution).
3. Right to Legal Counsel
You can and should speak to a lawyer before going to the police station. A lawyer can accompany you or guide you on what to say.
4. Right to Refuse Verbal Summons
If you haven’t received a written notice, you are not legally bound to appear. Always ask for the official copy under CrPC 41A.
⚖️ What Should You Do If Called by Police?
- Stay calm. Don’t panic.
- Ask for the reason and a copy of the notice
- Do not go alone—consult a criminal lawyer first
- Don’t sign or say anything without understanding
- If you feel threatened or harassed, inform your lawyer immediately
