What to Ask Your Lawyer at Every Trial Stage
Good criminal defence is a partnership: counsel knows procedure, but families hold dates, documents, and witness memories counsel cannot see from court alone. The wrong questions waste meetings (“Will we win?”). The right questions unlock action (“What must we prove on the next date?”). This question bank lists focused prompts for each of the thirteen stages under BNSS — use three to five per meeting, not the entire list at once.
How to use this bank
Before each meeting, write your stage number and latest order purpose. Pick questions only from that stage section plus the universal block at the end. Bring a notebook; record answers with dates.

- Is anticipatory bail realistically open — what documents do you need from us?
Stage 2 — Investigation
- Is investigation still open or nearing final report?
- What bail conditions are active and what violates them?
- Should we request preservation of CCTV, phones, or medical re-examination?
- When should family members meet IO — if at all?
- What material must we collect now before it disappears?
Stage 3 — Chargesheet
- Can we get a full copy with annexures this week?
- Do sections differ from FIR — why?
- Are we named or added late — what risk does that carry?
- Is closure report still possible in our fact pattern?
- Who are listed witnesses — do we know them?
Stage 4 — Cognizance
- Has cognizance been taken — on which date and sections?
- Any cognizance challenge open to us?
- What case number and court now control dates?
- Is limitation or sanction an issue visible on papers?
Stage 5 — Process and papers
- Summons or warrant — must accused attend every date personally?
- Have we received complete copies legally due to us?
- Is vakalatnama and surety documentation complete?
- What happens if co-accused is not served?
Stage 6 — Committal
- Is committal required in our offence — timeline?
- Which Sessions court takes over and what new number applies?
- Will charge be reframed at Sessions?
- Do we argue discharge at Magistrate, Sessions, or both?
Stage 7 — Charge
- Exact sections charged vs earlier papers — any alteration?
- Is discharge application pending or advisable?
- What elements must prosecution prove for each section?
- After charge, when does prosecution evidence realistically start?
Stage 8 — Prosecution evidence
- Which PW is next and what topic will they speak on?
- What contradictions are we tracking from FIR to court?
- Any exhibit chain gaps we should document?
- If witness absent again, what lawful steps can we request?
- Should family attend this date or stay away?
Stage 9 — BNSS 351 statement
- What incriminating circumstances will court put to accused?
- Have we prepared point-wise responses — what is our strategy on silence vs explanation?
- Will we file written statement — pros and cons for us?
- What must accused avoid saying that hurts later arguments?
Stage 10 — Defence evidence
- Are we leading defence evidence at all — why or why not?
- Which defence witnesses need summons — do we have their addresses?
- What documents must we bring for marking?
- How many dates should we budget?
Stage 11 — Final arguments
- Are written submissions needed from our side — deadline?
- What is our top three-point argument map?
- Will arguments be part-heard — how should we schedule attendance?
- Any recent judgments you want us to fetch or authenticate?
Stage 12 — Judgment
- Is judgment likely same day or reserved?
- Must accused be present — custody plan if convicted?
- If convicted, is sentence immediate or separate mitigation date?
- What certified copies should we apply for on outcome day?
Stage 13 — Appeal / revision
- What is limitation end date for our remedy?
- Appeal vs revision — which forum and why?
- Is bail / suspension pending appeal realistic — what papers needed?
- What errors from trial record ground our challenge?
Universal questions (every stage)
- Which single stage number are we in today per last order?
- What is the next date, purpose, and court room?
- What documents must we bring within seven days?
- What should family avoid doing this week?
- What fees / court costs are due before next date?
Questions to avoid wasting time
- “Can you guarantee acquittal?”
- “Should we contact the judge / IO informally?”
- “My neighbour’s case finished fast — can we skip stages?”
- “Can we argue everything in one application?”
This-week checklist
- Write stage number and last order quote at top of notebook.
- Select three stage-specific questions before calling counsel.
- Record answers with date; photograph any list counsel gives.
- Share answers with one family point-person only.
- Convert each answer into one physical task (copy, witness, attendance).
- Re-read universal questions if stage feels unclear.
- Schedule next meeting before prosecution evidence or 351 if near.
